What Changed
- Submission of proposed amendments to the Buildings Ordinance (Cap. 123) to the Legislative Council before the end of 2026, tripling maximum fines and introducing mandatory separation of building inspection and supervision functions.
- Establishment of the Building Maintenance Support and Services Council (BMSSC) by end of 2026 with HK$100 million start-up capital to provide professional assistance and oversee maintenance tendering.
- Formation of the Public Housing Building Control Section (PBC) in November 2026 to replace the Independent Checking Unit and restructuring of the Buildings Department starting Q1 2027.
On October 30, 2026, the Development Bureau (DEVB) and the Housing Bureau (HB) of Hong Kong SAR jointly announced comprehensive reform measures to the building maintenance regulatory regime and support services, following the findings of an Independent Committee report. The announced changes affect property owners, registered building inspectors, supervision consultants, construction contractors, and housing management bodies across Hong Kong SAR.
The Development Bureau will lead three primary structural initiatives:
1. Establishment of the Building Maintenance Support and Services Council (BMSSC): Set to be registered by the end of 2026 as a non-statutory company wholly owned by the Financial Secretary Incorporated, BMSSC will receive HK$100 million in start-up capital. It will offer both free and standard fee-charging services to property owners, utilize artificial intelligence to maintain cost databases, administer government subsidies, and take over about 1,800 existing project cases from the Urban Renewal Authority's 'Smart Tender' scheme. The council will eventually be designated as a public body under the Prevention of Bribery Ordinance (Cap. 201).
2. Amendments to the Buildings Ordinance (Cap. 123): The DEVB plans to submit proposed statutory amendments to the Legislative Council before the end of 2026. Key proposals include establishing 'large-scale repair' as a distinct statutory category requiring prior permits and site supervision plans, separating inspection duties from works planning and supervision to ensure professional independence, tripling maximum fines for statutory non-compliance, and establishing strict deregistration mechanisms for professionals or contractors convicted under the Prevention of Bribery Ordinance or Competition Ordinance.
3. Organizational Restructuring of the Buildings Department (BD): Beginning in Q1 2027, the BD will introduce two high-level divisions for new and existing buildings, reorganise territory coverage into ten district teams under a District Chief system, create a Dedicated Audit and Monitoring Section reporting directly to the Director of Buildings, and second a directorate officer to the Housing Bureau.
In parallel, the Housing Bureau will establish the Public Housing Building Control Section (PBC) within November 2026 to replace the Independent Checking Unit (ICU), implementing a project-based regulatory model for maintenance and renovation across public rental housing and subsidised sale housing courts.
