What Changed
- Gazetting of four new regulations and four sets of statutory amendments under Cap. 585, Cap. 128, Cap. 4, and Cap. 336.
- Establishment of procedural rules for registration, Land Titles Indemnity Fund management, fee items, and court proceedings.
- Tabling of subsidiary legislation at the Legislative Council on October 21, 2026, for negative vetting prior to phased implementation in 2027.
The Development Bureau (DEVB) of the Hong Kong Special Administrative Region gazetted eight pieces of subsidiary legislation on October 16, 2026, setting out operational details to implement a title registration system for new land. Following the passage of the Registration of Titles and Land (Miscellaneous Amendments) Ordinance 2025 by the Legislative Council (LegCo) in September 2025, the new framework proposes four new pieces of subsidiary legislation under the Land Titles Ordinance (Cap. 585) (LTO) and amends four existing pieces of subsidiary legislation under the Land Registration Ordinance (Cap. 128) (LRO), the High Court Ordinance (Cap. 4), and the District Court Ordinance (Cap. 336).
The initiative affects property buyers, real estate developers, commercial enterprises, legal practitioners, and financial institutions engaged in land and property transactions in Hong Kong. Under the framework, 'new land' refers to land held under a government lease granted on or after the operational date of the amended LTO, including land acquired via land sale, private treaty grant, and land exchange. Existing land registered under the LRO will remain governed by the current deeds registration system until it is converted.
The subsidiary legislation details application procedures and Land Registry processing, management of the Land Titles Indemnity Fund and indemnity claim procedures, new fee schedules, court proceeding rules, and electronic application mechanisms to align current deeds registration with the title registration system.
Transitioning to a title registration system aims to provide certainty of land ownership and streamline real estate transfers by eliminating the need to examine historical documents to prove title during transactions.
The subsidiary legislation will be tabled at the LegCo on October 21, 2026, for negative vetting. Certain provisions on electronic applications under the Land Registration (Amendment) Regulation 2026 and Land Registration Fees (Amendment) Regulation 2026 will come into force on October 4, 2027, alongside the e-lodgement system. The amended LTO and remaining subsidiary legislation will come into operation on a date to be announced separately by the Secretary for Development in the first half of 2027.
