Legal Update Cross-Border Hong Kong SAR Adopted legislation

Hong Kong Gazetted Subsidiary Legislation for New Mutual Service of Judicial Documents Framework with Mainland China

Hong Kong gazetted subsidiary legislation to implement the New Arrangement for mutual service of civil and commercial judicial documents with Mainland China.

What Changed

  • Gazetting of three court amendment rules on October 16, 2026, expanding the manners of document service on persons in Mainland China.
  • Establishment of an agreed entry-into-force date of March 30, 2027, replacing the 27-year-old existing arrangement.
  • Tabling of the subsidiary legislation at the Legislative Council on October 21, 2026, for negative vetting.

Litigants, legal practitioners, and businesses involved in cross-boundary civil and commercial disputes between Hong Kong SAR and Mainland China face procedural updates following the publication of new subsidiary legislation in Hong Kong.

On October 16, 2026, the Hong Kong SAR Government gazetted three sets of amendment rules: the Rules of the High Court (Amendment) (No. 2) Rules 2026, the Rules of the District Court (Amendment) (No. 2) Rules 2026, and the Matrimonial Causes (Amendment) Rules 2026. Made on October 12, 2026, by their respective rule-making authorities under section 54 of the High Court Ordinance (Cap. 4), section 72 of the District Court Ordinance (Cap. 336), and section 54 of the Matrimonial Causes Ordinance (Cap. 179), these rules establish updated procedures for serving judicial documents on persons in Mainland China.

The subsidiary legislation implements the "Arrangement on Mutual Service of Judicial Documents in Civil and Commercial Proceedings between the Mainland and the Hong Kong Special Administrative Region" (New Arrangement), which was signed by the Department of Justice (DoJ) and the Supreme People's Court (SPC) on April 20, 2026. This New Arrangement replaces the previous framework that had been implemented for over 27 years. To align implementation across both jurisdictions, the SPC will promulgate a judicial interpretation on the implementation of the New Arrangement in Mainland China. Both authorities agreed that the New Arrangement will officially come into force on March 30, 2027.

Key changes include adding manners of service of judicial documents for civil proceedings (including matrimonial proceedings) on persons in Mainland China to accommodate surging cross-boundary caseloads and enhance court efficiency. The Hong Kong SAR Government previously briefed the Legislative Council Panel on Administration of Justice and Legal Services on April 27, 2026, and consulted key legal stakeholders, including the Law Society of Hong Kong and the Hong Kong Bar Association.

The subsidiary legislation will be tabled at the Legislative Council on October 21, 2026, for negative vetting ahead of its scheduled commencement on March 30, 2027.
