Hong Kong Secretary for Justice Highlights Digital Trade Legislation and UNCITRAL Synergy at Legal Week 2026

Hong Kong Secretary for Justice Paul Lam delivered welcome remarks at Hong Kong Legal Week 2026, announcing upcoming trade digitalisation legislation based on UNCITRAL's Model Law on Electronic Transferable Records.

What Changed

  • Announcement of upcoming Hong Kong legislative amendments based on UNCITRAL's Model Law on Electronic Transferable Records to enable paperless B2B trade documents.
  • Recognition of the formal signing of the United Nations Convention on Negotiable Cargo Documents (Accra Convention) in Ghana for multimodal transport.
  • Highlighting ongoing Hong Kong-UNCITRAL collaboration on legal training, online dispute resolution, and professional secondments.

During the opening of Hong Kong Legal Week 2026 on 4 November 2026, Hong Kong Secretary for Justice Paul Lam, SC, delivered welcome remarks focusing on UNCITRAL's contributions to international trade law in the digital economy and outlining Hong Kong's latest digital trade initiatives.

**Legislative Amendments for Digital Trade Documents**

Secretary Lam announced that Hong Kong will introduce legislative amendments to facilitate the digitalisation of "Business-to-Business" (B2B) trade documents. These amendments are modeled on the UNCITRAL Model Law on Electronic Transferable Records (MLETR). The measure aims to support Hong Kong's role as an international trade hub by providing a modernized legal framework for paperless trade instruments.

**Global Milestones in Transport and Multimodal Legal Frameworks**

The speech noted the formal signing of the United Nations Convention on Negotiable Cargo Documents (the Accra Convention) in Ghana. The Accra Convention establishes a uniform legal regime governing negotiable cargo documents—in both paper and electronic forms—across air, road, rail, and sea transport modes, aiming to reduce documentary barriers in global supply chains.

**Collaboration between Hong Kong and UNCITRAL**

Secretary Lam detailed ongoing institutional cooperation between Hong Kong SAR and UNCITRAL:

- **Capacity Building:** Established in 2024, the Hong Kong International Legal Talents Training Academy collaborates with UNCITRAL on trade digitalisation programs, including an APEC workshop in Incheon, South Korea, and the 6th UNCITRAL Asia Pacific Judicial Summit.

- **Dispute Resolution Platforms:** Hong Kong partners with UNCITRAL on the Inclusive Global Legal Innovation Platform on Online Dispute Resolution (ODR).

- **Legal Talent Secondments:** Over 10 legal professionals from Hong Kong have been seconded to the UNCITRAL Secretariat in Vienna and its Regional Centre for Asia and the Pacific in South Korea.

**Impact on International Commerce**

These developments affect commercial entities engaged in international trade, freight transport operators, financial institutions, and dispute resolution practitioners. Aligning local law with international standards like MLETR aims to enhance legal certainty and interoperability across digital trade ecosystems.

Who May Be Affected

Businesses engaged in B2B cross-border trade, logistics and shipping operators, financial institutions providing trade finance, and international dispute resolution practitioners.

Cross-Border Context

Hong Kong SAR is modernizing its legal framework to align with international UNCITRAL standards (MLETR) and global instruments (Accra Convention), facilitating paperless trade and interoperability across Asia-Pacific and global trading partners.
