Hong Kong SAR to Gazette Statutory Orders Implementing Double Taxation Agreements with Six Nations

The Chief Executive in Council made six Orders under the Inland Revenue Ordinance (Cap. 112) to implement double taxation agreements with six countries.

What Changed

  • Six Orders were made on October 6, 2026, under Cap. 112 to implement CDTAs with Barbados, Jordan, the Kyrgyz Republic, Maldives, Norway, and Rwanda.
  • The Orders will be gazetted on October 16, 2026, and submitted to the Legislative Council on October 21, 2026, for negative vetting.
  • The CDTAs will enter into force after Hong Kong SAR and the respective treaty partners complete their internal ratification processes.

Investors, corporate taxpayers, and cross-border business operators in Hong Kong SAR and six partner tax jurisdictions face clearer statutory tax frameworks following new subsidiary legislation. On October 6, 2026, the Chief Executive in Council made six Orders under the Inland Revenue Ordinance (Cap. 112) to execute Comprehensive Avoidance of Double Taxation Agreements (CDTAs) signed with Barbados, Jordan, the Kyrgyz Republic, Maldives, Norway, and Rwanda.

The statutory Orders will be published in the Gazette on October 16, 2026, and subsequently tabled at the Legislative Council on October 21, 2026, for negative vetting. According to a spokesman for the Financial Services and the Treasury Bureau, the CDTAs ensure that residents of Hong Kong SAR and the respective partner jurisdictions will not be subject to double taxation on the same income. This enables cross-border investors to assess potential tax liabilities more effectively, thereby facilitating bilateral trade and investment.

The underlying treaties were signed between May 2025 and March 2026. Hong Kong SAR signed the CDTAs with Maldives in May 2025, Jordan in September 2025, Rwanda in October 2025, Norway in December 2025, and both the Kyrgyz Republic and Barbados in March 2026. With these additions, Hong Kong SAR has concluded CDTAs with 60 jurisdictions, 15 of which were signed under the current-term Government.

The six CDTAs will enter into force after Hong Kong SAR and each treaty partner complete their respective ratification procedures. Specific entry-into-force and application dates were not provided in the announcement.
