Tenue réussie du programme de formation d'experts en médiation internationale (NIMEP)

Dans la soirée du 30 janvier 2020 s'est tenu le programme de formation d'experts en médiation internationale (NIMEP) organisé par la Swiss-Chinese Law Association. Cinquante et un avocats locaux et étrangers, experts juridiques, hauts fonctionnaires et médiateurs issus de 20 pays ont participé à cette formation. Le thème de cette formation était l'étude de cas pratiques de médiation internationale. La formation s'est articulée autour de deux axes : la formation dispensée par des experts et la discussion de cas simulés. Les experts et universitaires ont partagé leurs expériences en matière de cas de médiation internationale sous différents angles pratiques. Les participants ont souligné que la formation avait été très fructueuse et avait permis d'améliorer leurs compétences pratiques dans la gestion des dossiers.

Phillip Hackett, QC from the UK, Peter Alfandary, Vice President of the British French Chamber of Commerce from the UK, Xiaobing Tang, Counsellor of the Market Access Department of the World Trade Organization from China, Dr. Agada Elachi, President of the Chartered Institute of Mediators and Conciliators from Nigeria, Olga Tsiptse, Advocate of the Supreme Court of Greece from Greece, and Dr. Tsiptse, Counsel of the Supreme Court of Greece from the UK. Tsiptse, a member of the Royal Institute of Chartered Arbitrators from the United Kingdom, and Paulo Fernando Pinheiro Machado, former Deputy Director of the European Department of the Ministry of Foreign Affairs of Brazil, explained the practical application of international mediation from various levels in the light of their own working experience. The training covered cultural diversity in agreement negotiations, revaluation of mediation, international mediation practice, and WTO case studies on international mediation. These cases are rich and diverse, involving both the application of international interventions, discussing the Singapore Mediation Convention and the New York Convention. It also involves the discussion of cases between public and private law, such as mediation of trade disputes between governments under the WTO, mediation of border issues between two countries, and mediation of corporate cross-border trade disputes; as well as training in mediation skills, such as how to deal with cultural differences, how to deal with historical legacy issues, and how to deal with silent techniques between negotiations. The members participated enthusiastically in the discussions.

La Swiss-Chinese Association a également invité sept universitaires et experts à discuter de cas simulés. Natascha Tunkel, associée chez KNOETZL ; Dr Alberto Elisaveasky, fondateur et président du Latin American Social Network Online Dispute Resolution ; Dr Daniel Brantes Ferreira, professeur à l'Université Candido Mendes et à l'Université Ambra ; Gunavathi Subra, professeure à l'Universiti Kuala Lumpur Malaysia. Les universitaires ont présenté de nombreux cas afin d'analyser, à différents niveaux, les facteurs influençant les affaires de médiation internationale, tels que les différences interculturelles. En outre, les experts ont partagé des aspects techniques permettant de gérer ces incertitudes et de parvenir à un modèle gagnant-gagnant dans les affaires de médiation internationale.

À la fin du programme, Natascha Tunkel, Hermann Knott et Tianze Zhang ont conclu la session par un récapitulatif des points clés et des enseignements tirés de la formation, et Hermann Knott a remercié l'ensemble des participants pour leur engagement et leur participation sérieuse durant l'après-midi et la soirée du samedi.
