Legal Update China Hong Kong SAR Court judgment

Hong Kong SAR Court of First Instance Sentences Wong Chi-fung to 10 Years' Imprisonment for HKNSL Collusion Offence

The Court of First Instance of the HKSAR sentenced Wong Chi-fung to 10 years' imprisonment after his guilty plea to conspiracy to commit collusion with foreign forces under Article 29 of the HKNSL.

What Changed

  • Wong Chi-fung received a 10-year prison sentence from the HKSAR Court of First Instance for national security collusion.
  • The court designated Wong Chi-fung and Law Kwun-chung as key masterminds responsible for lobbying foreign officials for sanctions.
  • The HKSAR Government announced the forfeiture of Wong's offence-related property and reaffirmed strict enforcement of national security legislation.

On November 5, 2026, the Court of First Instance of the High Court of the Hong Kong Special Administrative Region (HKSAR) sentenced Wong Chi-fung to 10 years' imprisonment. Wong had previously pleaded guilty on September 2 to the offence of "conspiracy to commit collusion with foreign countries or with external elements to endanger national security," contrary to Article 29 of the Hong Kong National Security Law (HKNSL).

According to the court’s reasons for sentence, Wong conspired with absconder Law Kwun-chung and others to solicit foreign countries and external elements to impose sanctions, blockades, or engage in other hostile activities against the People’s Republic of China, the HKSAR, and their officials. The court ruled that the offence was of a grave nature, noting that Wong and Law acted as masterminds and key advocates at the forefront of these efforts. They directly engaged with senior foreign officials and promoted calls for sanctions through social media and Western media outlets both before and after the HKNSL’s implementation. The court found that these actions contributed to the imposition of foreign sanctions that significantly impacted and endangered national security. Additionally, the HKSAR Government announced it would forfeit Wong's offence-related property in accordance with the law.

The judgment directly impacts individuals, non-governmental organisations, and political advocates involved in international outreach concerning Hong Kong SAR. In response to the sentencing, HKSAR Chief Executive John Lee and a government spokesman stated that Wong’s actions severely undermined national sovereignty, security, and social stability. The spokesman rejected criticisms and demands for release raised by foreign politicians and Western media, asserting that all legal proceedings in Hong Kong SAR are conducted strictly based on evidence and the rule of law.
