What Changed
- Tier 2 ESLS rules enforce a mandatory 3:1 local-to-imported staffing ratio and six-week local recruitment for production and table service posts in catering.
- Ninety-three catering sector applications failed preliminary screening between June 16 and September 2026 for non-compliance with the Tier 2 ratio.
- Vetting for Tier 2 applications requires an average of approximately four months after passing preliminary screening due to recruitment verification procedures.
Employers operating in Hong Kong SAR's food and beverage services sector face strict staffing ratio and local recruitment requirements under the Tier 2 vetting mechanism of the Enhanced Supplementary Labour Scheme (ESLS). Responding to a question in the Legislative Council on October 21, 2026, the Secretary for Labour and Welfare, Mr Chris Sun, detailed the operational framework, vetting timelines, and recent statistics under the scheme.
Implemented on June 16, 2026, the Tier 2 vetting mechanism applies specifically to posts in the production section and table service section of the food and beverage services sector. Employers seeking imported workers for these posts must maintain a 3:1 manning ratio of full-time local employees to imported workers, calculated on the basis of all posts within the respective section. Employers must also undergo a six-week local open recruitment process, which includes attending an onsite job fair every two weeks at a Labour Department (LD) job centre.
Official figures provided by the Secretary reveal the operational impact of the scheme:
- From January to June 2026, the ESLS received 1,905 applications from the food and beverage sector involving 13,573 imported workers. From July to September 2026, it received 890 applications involving 4,996 imported workers.
- From June 16 to September 2026, 93 applications failed preliminary screening because employers were unable to meet the Tier 2 manning ratio requirement.
- Average vetting time for Tier 2 applications that pass preliminary screening is expected to take about four months, reflecting the extended six-week local recruitment requirement and follow-up procedures.
- Between June 16 and September 2026, 219 catering employers participated in Tier 2 job fairs, offering 1,276 vacancies and conducting 137 on-the-spot interviews.
To promote local employment of individuals with disabilities, the LD maintains a relaxed 1:1 manning ratio of full-time local employees with disabilities to imported workers, which applies across all ESLS sectors including catering under Tier 2. The Government confirmed it will dynamically monitor labour market conditions and adjust importation arrangements as appropriate.
