The Fanling Magistrates' Courts and West Kowloon Magistrates' Courts in Hong Kong SAR have sentenced three incoming passengers to custodial terms ranging from four weeks to six months, together with fines between $1,000 and $4,000, for offences involving duty-not-paid cigarettes and alternative smoking products.
According to press releases issued by the Hong Kong Government on October 22 and October 23, 2026, the convictions involved interceptions made by Customs officers across two boundary control points:
First, on September 22, 2026, Customs officers at the Heung Yuen Wai Boundary Control Point intercepted an 84-year-old local male passenger. Officers seized 801 duty-not-paid cigarettes from him, with an estimated market value of about $3,600 and a duty potential of about $2,600. On October 22, 2026, the Fanling Magistrates' Courts sentenced him to three months' imprisonment and a fine of $1,000 for possessing duty-not-paid cigarettes and failing to declare them to Customs officers, in contravention of the Dutiable Commodities Ordinance (DCO).
Second, on October 21, 2026, Customs officers at Hong Kong International Airport intercepted a 39-year-old incoming Mainland male passenger. Officers seized 181 duty-not-paid cigarettes and 21,600 alternative smoking products from his personal baggage, with an estimated market value of about $83,000 and a duty potential of about $600. On October 23, 2026, the West Kowloon Magistrates' Courts sentenced him to four weeks' imprisonment and a fine of $4,000 for contraventions of the DCO (Cap. 109) and the Import and Export Ordinance (IEO) (Cap. 60).
Third, on October 22, 2026, Customs officers at Hong Kong International Airport intercepted a 31-year-old incoming Mainland male passenger. Officers seized about 73,000 duty-not-paid cigarettes from his personal baggage, with an estimated market value of about $330,000 and a duty potential of about $240,000. On October 23, 2026, the West Kowloon Magistrates' Courts sentenced him to six months' imprisonment and a fine of $2,000 under the DCO.
Hong Kong Customs welcomed the sentences, stating that custodial penalties impose a considerable deterrent effect. Under the DCO, importing, dealing with, possessing, selling, or buying illicit cigarettes carries a maximum penalty of a $2 million fine and seven years' imprisonment. Under the IEO, importing alternative smoking products into Hong Kong carries an identical maximum penalty.
