Hong Kong Hospital Authority Accepts Privacy Commissioner's Findings Following Health Data Breach Investigation

The Hospital Authority accepted the Privacy Commissioner's investigation recommendations following a patient data breach involving a maintenance contractor in the Kowloon East Cluster.

What Changed

  • The Privacy Commissioner for Personal Data published an investigation report regarding an April patient data theft incident in the Kowloon East Cluster.
  • The Police arrested a contractor staff member on suspicion of access to a computer with dishonest intent, with the criminal investigation ongoing.
  • The Hospital Authority implemented revised contractor oversight policies, requiring IT staff accompaniment, access auditing, role-based restrictions, and routine risk assessments.

Public healthcare institutions, IT service contractors, and privacy compliance professionals operating in Hong Kong SAR are affected by revised vendor management and system security expectations following the response of the Hospital Authority (HA) to a major data privacy investigation.

On October 30, 2026, the HA issued a public statement accepting the findings and recommendations published by the Office of the Privacy Commissioner for Personal Data (PCPD). The investigation examined an April incident in the Kowloon East Cluster (KEC), where routine surveillance detected the theft and unlawful third-party platform uploading of patient data. The breach was identified as an isolated event linked to access control management during maintenance work on a peripheral clinical system by an external contractor. The HA previously reported the breach to law enforcement, leading to the arrest of a contractor employee by the Police on suspicion of accessing a computer with dishonest intent. Criminal investigations remain ongoing.

In response to the PCPD's recommendations, the HA and KEC implemented an enhanced security strategy governing contractor access during system maintenance. The required measures include:

1. On-site Accompaniment and Logging: Mandating that contractor personnel accessing systems on-site are accompanied by authorised hospital IT staff, with comprehensive logs recorded for identity, purpose, operation times, and equipment brought in or out.

2. Access Auditing: Establishing routine data access audits and requiring contractors to submit periodic audit reports detailing anomalous, unauthorised, or suspicious activities.

3. Strict Access Control: Reconfiguring access rights based strictly on roles and functions, restricting system use to authorised personnel, and prohibiting data exports except under specifically approved circumstances.

4. Independent Security Risk Assessments: Conducting regular joint security risk assessments and audits between cluster IT departments and the HA Head Office Information Technology and Health Informatics Division.

The HA confirmed that the KEC previously notified and apologized to affected patients and staff. Moving forward, the HA intends to maintain continuous system monitoring, execute periodic testing, and liaise with the PCPD, law enforcement, and professional cybersecurity bodies to protect personal data.
